The Home Ministry has submitted an eight-page affidavit to the Supreme Court today, demanding that Rohingya Muslims can not be allowed to stay back in India and must be deported back to where they came from. Talking to mediapersons on the sidelines of an event in the capital on Friday, Mr Singh said, "We will file the affidavit in Supreme Court on September 18".

The Supreme Court, petitioned by Rohingya refugees seeking stay on government's order to deport them, was told by Centre on Thursday that the decision to send them back is in "larger interest of the nation".

Around 40,000 Rohingyas - Muslims who fled Myanmar as violence against the ethnic minority spiked in the Rakhine region - have settled in India. The flight of almost 3,00,000 Rohingya to neighbouring Bangladesh is a testimony to the wretchedness of their condition.

The Congress has urged the Narendra Modi government to be "careful" on the issue of Rohingya Muslim refugees from Myanmar and "not stereotype or identify hapless victims of violence with insurgency and terrorism".

In a statement issued in Lucknow on Wednesday, Mayawati said that the Centre should not force state governments to adopt a stern stand towards Rohingya refugees. The Supreme Court has fixed 18 Sep as the date for the hearing of the plea and the Home Minister said it will file the affidavit on 18 Sep.

The government's draft affidavit says there is no "violation of fundamental rights of the petitioner" in this case.

Since the Rohingya are considered to be illegal Bengali immigrants and were denied recognition as a religion by the government of Myanmar, the dominant group, the Rakhine, rejects the label "Rohingya" and have started to persecute the Rohingya.

Both UN and human rights activists argue that despite India not being a signatory to the UN Refugee Convention, it is bound by worldwide principles of non-refoulement which holds that no nation should deport a refugee to territories where his life or freedom would be under threat based on his race, religion, nationality, or membership of a social or political group.
