Weiner's lawyers cite 'remarkable progress' in probation request

His lawyers argued in the memo that a prison term "would bring Anthony's indisputably successful treatment for the sickness underlying his crime to an immediate and complete halt".

Weiner pleaded guilty to one charge of transmitting obscene material to a minor in May. "As she later stated to Government investigators, she also hoped to somehow influence the US presidential election, in addition to securing personal profit".

That discovery led to the late October announcement by James B. Comey, then the F.B.I. director, that the bureau had opened a new investigation into Mrs. Clinton's handling of official email, an inquiry that ended two days before the election. They appeared together in divorce court on Wednesday.

Abedin announced that she was separating from Weiner last summer, after a woman came forward to say Weiner had sent her a provocative photo of his crotch while he was lying in bed with his young son.

In Wednesday's sentencing submission to the judge who will sentence Weiner later this month, his attorneys requested no prison time, calling his offense, "far less egregious than any sexting case that has been prosecuted in this district". Even as the lawyers recounted the girl's role in encouraging Weiner to participate in the explicit message exchange, they said in the court filing that Weiner "never should have responded" and he doesn't treat the circumstances "as a justification".

The teenage girl first contacted Mr. Weiner on January 23, 2016, and he "responded as a weak man, at the bottom of a self-destructive spiral, and with an addict's self-serving delusion that the communications were all just internet fantasy - willfully ignoring that there was a young person at the other end of the connection, hundreds of miles away, who could be damaged by these exchanges through the ether", his lawyers wrote.

Weiner, 53, submitted his own letter to the court in which he apologized and said he was continuing to seek treatment.

"My continued acting out over years crushed the aspirations of my wife and ruined our marriage", Weiner wrote.

"This is not a letter I ever imagined I would write, but, with Anthony, I have repeatedly found myself in circumstances I never imagined", Abedin wrote in her letter, the public version of which was heavily redacted.

Abedin and Weiner are in the midst of getting a divorce.

As part of the FBI investigation, agents seized Weiner's laptop computer, which had emails to Abedin, a senior adviser to Clinton's presidential campaign.

He said "the one ideal thing in my life - my son - will forever have to answer questions about the public and private failings of his father".

But when BuzzFeed News spoke with them before the election, both she and her father said they did not support Donald Trump.

The guilty plea marks the final fall from grace of Weiner, who resigned from Congress-after more than a decade serving New York's 9th district-in 2011 after revelations that he had sexted with numerous women. Weiner ran for mayor of New York City in 2013, a bid scuttled by a similar sexting scandal.
