The New York Times reports that Bernstein sued O'Reilly for defamation and breach of contract, arguing that his public statements about the settlement violated the terms of the agreement, which includes nondisclosure and non-disparagement clauses.
Rachel Witlieb Bernstein was a junior producer for the network in 2002. According toBernstein's lawsuit, there was no hotline at the time, and she in fact told others at the network about the mistreatment.
"He's gone far beyond that and painted our client in a bad light", lawyer Neil Mullin told WaPo, claiming that O'Reilly violated the 2002 settlement case by implying that Bernstein's claims were politically motivated, Variety reported.
The lawsuit, filed in NY federal court, accuses O'Reilly and Fox News of defamation and breach of contract stemming from a 2002 settlement between them and former Fox News producer Rachel Witlieb Bernstein.
O'Reilly made a statement to The New York Times last April, which triggered Bernstein's lawsuit. "The case did not involve sexual harassment".
Her lawsuit also claims that O'Reilly's statements that no complaints were filed against him are "deliberately misleading". O'Reilly screamed at Bernstein in front of other employees, according to the New York Times.
Bernstein, who was one of those women, says O'Reilly has since disparaged her in the media as a liar and extortionist.

O'Reilly allegedly made other, similar comments since then.
O'Reilly was sacked on April 19 from Fox News after a 20-year run at the cable network.
"O'Reilly portrayed himself as a "target" and claimed the complaints against him were extortionate", the suit read. "This is false. In fact, he is a serial abuser and Ms. Bernstein's complaints about him were far from extortionate".
O'Reilly, who lost his job at Fox because of harassment claims, has emphatically denied wrongdoing.
Bernstein's attorneys said in a statement Monday that she "was not the source for this revelation". Mullin's law firm, Smith Mullin, also represented former Fox News host Gretchen Carlson, who alleged she was harassed by the late Fox News Chairman Roger Ailes.
O'Reilly was constrained out of Fox News in April following a progression of disclosures about affirmed lewd behavior and manhandle.
